INFORMATION ACCESS LAW NO. 4982

INFORMATION TEXT FOR REAL AND LEGAL PERSONS

Our foundation is obliged to ensure that real and legal persons can exercise their right to access information in accordance with the provisions of the Information Access Law No. 4982 and the Regulation on the Principles and Procedures Regarding the Implementation of this Law, in line with the principles of transparency, accountability, and openness.

1. Right to Apply for Real and Legal Persons

  • Real Persons: Citizens of the Republic of Turkey and foreign real persons residing in Turkey (provided that the principle of reciprocity is observed and the requested information is related to themselves or their area of activity) can apply to our foundation for access to information.
  • Legal Persons: Legal entities operating in Turkey (companies, associations, chambers, etc.) have the right to apply through their legal representatives to access information or documents related to their titles and areas of activity.

2. Application Channels and Contact Information

Information access applications are accepted through the following official channels in accordance with the formal requirements stipulated by the law:

  • Physical Application (Mail/Cargo/In Person): [Foundation Physical Address] with a wet signed petition.
  • Email (E-Mail): To the designated email address for the Information Access Unit, [Foundation Information Access E-Mail Address].
  • Registered Electronic Mail (KEP): To our foundation’s official [Foundation KEP Address] using a secure electronic signature.

3. Mandatory Information and Conditions in Applications

  • In Applications by Real Persons: The applicant’s name and surname, signature, Turkish ID number (passport/ID number for foreigners), and clear residential or business address.
  • In Applications by Legal Persons: The title and address of the legal entity, along with the authorized person’s Turkish ID number, signature, and authorization document in the application petition.
  • Important Note: Applications containing incomplete information, those whose identity cannot be verified, or unsigned applications will not be processed as per the law.

4. Matters Excluded from the Scope of the Law and Rejected Issues

In order to protect the rights of our martyrs’ relatives, veterans, and donors, applications for the following types of information and documents will be definitely rejected:

  • Privacy of Private Life and KVKK: Personal data, addresses and contact information, financial aid documents, health reports, disability degrees, and any information regarding the private lives of our martyrs’ relatives and veterans cannot be shared with third parties (according to Article 21 of Law No. 4982 and Law No. 6698 on the Protection of Personal Data).
  • Requests Requiring Separate or Special Work: If the information or document requested by the applicant requires separate research, special examination, analysis, or work by the foundation, the request will be denied (Article 7).
  • Internal Regulations and Drafts: Internal correspondence, draft reports, recommendations, and opinions of the foundation that have not yet been finalized or approved by the board of directors (Article 25).
  • Trade Secrets and Economic Interests: Information that is considered trade secrets related to the foundation’s economic enterprises or subsidiaries (Article 22).

5. Response Time and Procedure

  • Our foundation will conclude information access applications made in accordance with the procedure within a maximum of 15 business days from the date the petition or electronic communication is registered in the foundation’s records.
  • If the requested information or document concerns another institution or requires additional examination, the response time may be extended up to a maximum of 30 business days. In this case, the extension of the period and its justification will be communicated to the applicant in writing within the first 15 business days.

6. Pricing Principle

In the case of duplication (photocopying, scanning, transferring to digital media, etc.) or sending by cargo/post of the documents requested within the scope of the information access application, the administrative and logistical costs incurred will be charged to the applicant in accordance with Article 10 of the Law. Documents will not be delivered until the determined cost is deposited into the foundation’s account.
